Terms and Conditions

Please carefully read the following Terms and Conditions.
1. Introduction

1.1 Talent Corporation Malaysia Berhad (Company No.: 919577-H) (“TalentCorp”) has been established under Prime Minister’s Department to initiate and facilitate initiatives that will help country meet its talent needs, by working closely and building partnerships with leading companies and government agencies (“Objective”).

 1.2 Pursuant to the above Objective, TalentCorp has implemented an initiative known as ‘#DearPal’, a new initiative under the ‘MyASEAN Internship programme’ with the main purpose to encourage peer-to-peer pensive conversation amongst ASEAN youths on cultural integration, personal interests and passions, career aspirations and global issues through e-letter exchange. (“#DearPal Programme”).

 1.3 The objective of the #DearPal Programme are as follows including but not limited to:

(a) foster an ASEAN identity through inter-cultural understanding; and

(b) build an ASEAN network of young talents

 1.4 These terms and conditions shall constitute entire agreement between the participant (“Participant(s)”) and TalentCorp pursuant to Participant’s involvement in the #DearPal Programme (“Terms and Conditions”). By participating in the #DearPal Programme, the Participant hereby agree and undertake with TalentCorp to be bound by the following Terms and Conditions.

 2. Details of the #DearPal Programme

 2.1 Concept

(a) The #DearPal Programme shall provide ASEAN youths with opportunity for a peer-to-peer virtual session to create conversation amongst ASEAN youths on cultural integration, personal interests and passions, career aspirations and global issues through e-letter exchange.

2.2 Mechanism

(a) Format

(i) Casual one-to-one virtual interaction through e-letter exchange.

(ii) The duration of the virtual interaction is for a period of 2 weeks between 2 matches.

(b) Template for the e-letter

(i) The template for the e-letter shall be provided by TalentCorp via email to the Participants. The Participants are allowed to print, hand-write, scan or write electronically. 

(c) Criteria

(i) The Participant must be ASEAN nationality.

(ii) The Participant must be between 18 to 25 years old.

(iii) The Participant must have interest in cross-cultural and cross-societal learning.

(iv) The Participant must be able to commit time to correspond with other participants.


3. Roles and Obligations of TalentCorp and Participant

(a) Role of TalentCorp for #DearPal Programme
            
(i) TalentCorp is only acting as a liaison entity between the Participant and the Participant’s match for the #DearPal Programme.

(ii) TalentCorp is responsible in arranging and matching application made by the Participant under the #DearPal Programme and each match is subjected to the sole discretion of TalentCorp.

(b) Role of Participant for #DearPal Programme

(i) Participant shall provide written notification to TalentCorp in the event of changes in contact details of Participant including but not limited to the changes in email address, telecommunication numbers, or any other information for TalentCorp’s record purposes.

(ii) Participant is required to complete online feedback and provide softcopy of e-letters (as instructed by TalentCorp) to TalentCorp upon completion of the two (2)-week virtual interaction.

(iii) Participant shall abide to the code of conduct and all provisions or rules as described under this Terms and Conditions throughout participation in the #DearPal Programme including other terms and conditions that may be imposed by TalentCorp from time to time.


4. Personal Data Protection

4.1 By participating in the #DearPal Programme, the Participant hereby agrees that TalentCorp, including but not limited to its partners, employees, agents and/or representatives, to collect, store, process and/or use the Participant’s personal data, which may include but not limited to Participant’s name, address, telephone number, national registration identification card number and email address (“Personal Data”), for the purpose of it was collected, which among others are for the purpose of the #DearPal Programme.

4.2 The Participant hereby gives consent to TalentCorp, including but not limited to its partners, employees, agents and/or representative, to disclose the Personal Date to relevant authorities and/or third parties, where required by law or for legal purposes.

4.3 The Participant hereby acknowledge and agree that the collection, management, storage and disclosure of such Personal Data shall be in accordance with TalentCorp’s privacy policy which is located at https://www.talentcorp.com.my/policy/privacy (“Privacy Policy”).
5. Disclosure of Personal Information and Interaction with a Third Party

5.1 By agreeing to take part in the #DearPal Programme, the Participant hereby agrees that the Participant’s email address and other submitted data may be made available to another matched Participant by TalentCorp for the purpose of the #DearPal Programme.

5.2 It is advisable for the Participant to do due diligence and/or additional queries of which the Participant may think are appropriate and/or necessary prior to the online or offline interaction with the matched Participant. Participant hereby agrees that TalentCorp shall not be liable for any damages and/or losses that may be suffered by the Participant (directly or indirectly) due to Participant’s interaction with the matched Participant.

 
6. Confidential Information

6.1 The Participant agrees that all information including the details of the matched Participant or other information that have been disclosed by the matched Participant or other party to the Participant pursuant to the #DearPal Programme (“Confidential Information”) shall be treated strictly confidential and the Participant agrees to be bound by the following confidentiality obligations:

(a) unless permitted under this Terms and Conditions, the Participant shall not disclose the Confidential Information to any third party without prior written consent from the owner of the Confidential Information; and

(b) the confidentiality obligations set forth herein shall only apply to Confidential Information save with respect to information after such disclosure, through no fault of the Participant, become generally available to third parties or whereby the Participant is required by law, a Court of competent jurisdiction or regulatory authorities to disclose such Confidential Information.

6.2 If the Participant aware on any improper collection and/or misuse of Confidential Information resulting from the Participant’s involvement in the #DearPal Programme, such improper collection and/or misuse should be reported to get@talentcorp.com.my.
7. Code of Conduct

7.1 The Participant hereby agree that it is a condition of the Participant’s participation in the #DearPal Programme that the Participant shall not:

(a) impersonate or claim the identity or characteristics of any person or entity, falsely claim an affiliation with any person or third party, or submit false, misleading, or inaccurate information pertaining to your identity;

(b) post or transmit any fraudulent, unlawful, threatening, abusive, libellous, defamatory, scandalous, inflammatory, obscene, racist, vulgar, pornographic, hateful, profane, criminal, or offensive material of any kind, including any material that would violate any local, state, national, or international law, or give rise to any civil or criminal liability;

(c) post or transmit material that victimises, harasses, degrades, or intimidates an individual or group on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;

(d) post or transmit any material that violates or infringes the rights of others, including material that is an invasion of privacy or publicity rights or that infringes on any intellectual property or contractual rights;

(e) violate confidentiality of restricted information or reveal any trade secret information that you have either explicitly or implicitly agreed to keep confidential;

(f) post or transmit material that encourages criminal conduct or conduct that might create civil liability for TalentCorp;

(g) infringe or violate the copyrights, trademarks, patents, trade secrets, or other intellectual property/proprietary rights of TalentCorp or any third party;

(h) post or transmit any material containing software viruses or similar disabling devices; and

(i) post or transmit any unsolicited advertising, material that is junk mail, encrypted, or invades a person’s privacy, or encourages any conduct that would constitute a criminal offense or give rise to any civil liability or that violates any local, state, federal, national, or international law or regulation;
(collectively as “Code of Conduct”).

7.2 Any violation of the Code of Conduct will result in expulsion from the #DearPal Programme. Any violation of the Code of Conduct should be reported to get@talentcorp.com.my immediately.


8. Intellectual Property Rights

8.1 All reports, materials and/or compilation of materials pursuant to the #DearPal Programme shall become the exclusive properties of TalentCorp and shall not be returned to the Participants. The Participant hereby agrees to grant TalentCorp, including but not limited to its partners, employees, agents and/or representatives, unconditional and irrevocable rights to publish such reports, materials and/or compilation of materials in any formats at TalentCorp’s website or other platforms as determined by TalentCorp.


9. Violation of Laws

9.1 Any attempt to deliberately damage or undermine the legitimate operation of this #DearPal Programme is a violation of criminal and civil laws and TalentCorp, including but not limited to its partners, employees, agents and/or representatives of the #DearPal Programme   reserve the right to seek damages from those making such attempts to the fullest exte
10. Governing Law

10.1 The #DearPal Programme and all disputes and differences arising hereunder shall be governed by and interpreted in according with the laws for the time being in force in Malaysia. Parties hereby agree to submit to the exclusive jurisdiction of the courts of Malaysia in respect of any claim or proceeding arising from this terms and conditions, and to obey any order or judgment of the courts in respect of such claim or proceedings.

 
11. Exclusion of Liability

11.1 In no event will TalentCorp be liable to the Participant or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages. By agreeing to these Terms and Conditions, the Participant agrees to indemnify and hold TalentCorp, its subsidiaries, affiliates, officers, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable legal fees, made by any third party due to or arising out of the Participant’s participation in the #DearPal Programme.

 
12. Miscellaneous

12.1 TalentCorp reserves the right at its absolute discretion and without liability to:

(a) change, modify, alter, adapt, add or remove any of the terms and conditions contained herein; and/or

(b) change, suspend or discontinue any aspect of the #DearPal Programme.

12.2 Such changes as described above will be posted on TalentCorp’s website, if functioning.
